   DIRECTIVE 2008/98/EC OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 19 November 2008 on waste and repealing certain Directives

This new directive gives the base for a future Norm that allows to controll better the lubricant waste oils management, limiting the transboundary shipment for incineration and priorizing the material valuation, that's the regeneration. In general lines, PREVENTS THE MASSIVE ENERGETICAL VALUATION.

As defined in Order 6th September 1998 (DOGC nº 1055 14/10/1998):

"Used oil is any industrial oil of mineral or lubricating base that is inappropriate for the use which it was originally assigned, and in particular used combustion engine oils and those from transmission systems, oil for turbines and hydraulic systems and especially those motor oils from automotion garages and the oil from ship engines"

     

 

The Law 20/1986 14th May (DOGC) basic of toxic and dangerous residues (RTP) based on the waste law of 20th March 1978 (78/319/CEE) , published in DOCE 31st March 1978 , and reaffirmed in its content by the Order of 28th February, published in BOE 8th March 1989 (in agreement with the directives 75/439/CEE 16th June 1975 and 87/101/CEE of 22nd December 1986), defines used oil as a toxic and dangerous special waste that cannot be dumped nor burned due to its highly contaminating content, heavy metals and mutagenic and carcinogenic elements.

     

  

The waste regulator law 6/1993 15th July (DOGC 1776 de 28.07.1993) declares the treatment of used oil, among other special residues, a public service of the Generalitat de Catalunya. This law is based on the European directives 91/156/CEE 18th March and 91/689/CEE 12th December that modify previous regulations about this matter.

      

  

The classification of used oils is governed by the European Waste Catalogue (CER) , published in BOE nº 7 8th January 1999 and according to the resolution of 17th November 1998 from the Dirección General de Calidad y Evaluación Ambiental. .This catalogue or list of dangerous residues comes from the list established by the Decisión del Consejo of 22nd December 1994 in virtue of section 4 article 1 of the directive 91/689/CEE relative to dangerous residues . Also approved in the Real Decreto 952/1997.
